Article 1 – Scope

 

These Terms and Conditions govern all sales concluded through motorsportcollectors.com, specializing in authentic motorsport memorabilia and collectible items.


Placing an order constitutes full acceptance of these Terms.

 


 

Article 2 – Nature of the Products

 

The products offered are authentic collectible items, often unique and sometimes race-used.


Certain products may show signs of use, age, or race wear. These characteristics are inherent to their historical value and do not constitute defects.


Product photographs represent the actual item offered for sale. Minor variations in color or perception may occur depending on screen settings.

 


 

Article 3 – Prices

 

All prices are displayed in euros (€) unless otherwise indicated.


VAT not applicable – Article 293 B of the French Tax Code.


Shipping costs are indicated prior to order confirmation.


For orders delivered outside the European Union, customs duties, import taxes, and local charges may apply and remain the sole responsibility of the buyer.

 


 

Article 4 – Payment

 

Payments are processed through secure payment providers available on the website.


The seller reserves the right to:

 

  • Refuse or cancel any order in case of suspected fraud

  • Request identity verification or additional documentation for high-value transactions

 

For substantial amounts, payment by bank transfer may be required.

 


 

Article 5 – Shipping and Transfer of Risk

 

Orders are shipped via secure carriers (DHL, UPS or equivalent), including:

 

  • Tracking number

  • Signature upon delivery

  • Transport insurance

 

Delivery times are estimates only.


Risk transfers to the buyer upon handover of the package to the carrier.

 


 

Article 6 – Right of Withdrawal (EU Customers)

 

In accordance with European consumer protection law, customers residing within the European Union have fourteen (14) calendar days from receipt of the goods to exercise their right of withdrawal.


Conditions:

 

  • Item must be returned in its original condition

  • No damage, alteration, or excessive handling

  • All certificates and accessories included

 

Return shipping costs are the responsibility of the customer.


The item must be returned using a secure and insured shipping service covering the full declared value.


Any depreciation resulting from handling beyond what is necessary to inspect the item may result in a partial deduction.

 


 

Article 7 – Exclusions from the Right of Withdrawal

 

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to:

 

  • Custom or personalized products

  • Sealed items that have been opened and cannot be resold

  • Special orders made upon specific request

 


 

Article 8 – Limitation of Liability

 

The seller shall not be held liable for improper use of the product.


Liability is strictly limited to the amount of the order.

 


 

Article 9 – Governing Law

 

These Terms are governed by French law.


In the event of a dispute, an amicable solution shall be sought prior to legal proceedings.
